Ensures the safety and structural integrity of exterior elements, like balconies, decks, stairways, and walkways in multifamily. Building owners are responsible for arranging inspections, and maintain compliance.

Applicability & Timeline Requirement

SB721 applies to buildings with three or more multifamily units in California. Property owners must complete the initial inspection by January 1, 2026, with subsequent inspections required every 6 years, but this does not mean you need to wait until then.

Repair Timeline & Associated Penalties

Deficiencies classified as hazardous must be repaired within 120 days after the inspection report is submitted. Non-compliance may result in fines, legal liabilities, and potential safety hazards.

SB-721 Inspection Candidates

Buildings With 3 or More Units, And Exterior Elevated Elements (EEE), e.g., Balconies, Stairs, Decks, and Walkways.

SB-721 and SB-326 require inspections of Exterior Elevated Elements (EEE) by 2025. Buildings that are proposed for conversion to condominiums to be sold to the public after January 1, 2019, must be inspected prior to the first close of escrow. EEE inspections, as well as any required maintenance or repair which is identified as a result of the inspection, are the responsibility of the private property owner. While some local governments already impose a local inspection program, this California law requires inspection of specific balconies throughout California.
